Acceptance of these terms
These Terms of Service ("Terms") are a legal agreement between you ("Operator") and Mobile Eats Software LLC, the company behind MobileEats ("we," "us," or "our"). By creating an account or using the MobileEats platform, you agree to be bound by these Terms.
If you do not agree to these Terms, do not create an account or use the platform. We reserve the right to update these Terms at any time. Continued use of MobileEats after changes are posted constitutes acceptance of the revised Terms.
The Service
What MobileEats provides
MobileEats is a website builder platform designed for food truck operators. It allows you to create and manage a public-facing website including pages, menus, schedules, and a customer contact form.
We reserve the right to modify, suspend, or discontinue any part of the platform at any time. In the event that we choose to discontinue MobileEats entirely, we will provide operators with reasonable advance notice so that you have time to retrieve your content before the service ends.
Accounts
Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
You must provide accurate information when creating your account and keep it up to date. Accounts may not be transferred to another party without our written consent.
Trial & Billing
Free trial and subscription
Free trial
New operators receive a 14-day free trial to evaluate the platform. No payment information is required to begin your trial. If you choose to subscribe during your trial period, your paid billing cycle begins on the date you subscribe — not at the end of the remaining trial period. Any unused trial days are forfeited upon subscription.
Subscription
MobileEats is offered on a month-to-month subscription basis. Your subscription renews automatically each month on the anniversary of your billing start date. Payments are processed securely through Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation, your subscription remains active through the end of your current billing period. We do not offer prorated refunds for unused days in a billing period.
Refunds
All subscription fees are non-refundable. In limited circumstances — such as an accidental charge where you contact us within 72 hours of the renewal date — we may issue a refund at our sole discretion. This is not a guarantee and does not constitute a general refund policy.
Acceptable Use
What you may and may not do
MobileEats is intended for use by legitimate food truck operators to promote their business and connect with customers. You agree not to use the platform to:
- Post content that is false, misleading, defamatory, or deceptive
- Violate any applicable local, state, or federal law or regulation
- Infringe on the intellectual property rights of any third party
- Transmit spam, unsolicited messages, or malicious code
- Attempt to gain unauthorized access to any part of the platform or its infrastructure
- Use the platform for any purpose other than operating a legitimate food truck business
We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.
Your Content
Ownership and responsibility
You retain ownership of all content you upload or create through MobileEats — including text, images, menus, and business information. By publishing content through the platform, you grant Mobile Eats Software LLC a limited, non-exclusive license to host, display, and deliver that content solely for the purpose of operating your site.
You are solely responsible for ensuring that your content does not violate any laws or third-party rights. We do not claim ownership of your content and will not use it for any purpose beyond providing the service.
Customer Communications
Contact form and customer data
Each MobileEats site includes a customer contact form. Messages submitted through this form pass through our servers and are delivered to you as the operator. You are the data controller for any customer information you receive through this form and are solely responsible for how you handle, store, and respond to those communications.
You agree to handle customer communications in compliance with applicable privacy laws and not to use customer contact information for unsolicited marketing or any purpose unrelated to the inquiry received.
Disclaimers
Service provided as-is
MobileEats is provided "as is" and "as available" without warranties of any kind, express or implied. Mobile Eats Software LLC does not warrant that the platform will be uninterrupted, error-free, or free of security vulnerabilities.
We are not responsible for any loss of content, revenue, or business opportunity resulting from platform downtime, technical issues, or service discontinuation.
Liability
Limitation of liability
To the fullest extent permitted by law, Mobile Eats Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.
In no event shall our total liability to you exceed the amount you paid to Mobile Eats Software LLC in the three months preceding the claim.
Governing Law
Jurisdiction and disputes
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Missouri.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
